Wheelchair Transport Injury

In a report from the MDH it is alleged that Rochester Rehab and Living Center a staff member to neglected a resident when he failed to secure the resident’s wheelchair in the van during transport. During transport the, the wheelchair tipped over backwards, and the resident hit her head in the van.

MDH Substantiated Neglect Against Rochester Rehab

The Minnesota Depart of Health determined neglect was substantiated. The AP was responsible for the maltreatment. The AP did not follow procedure when he did not secure all the wheelchair straps to the van. Afte the incident, the AP drove the dialysis appointment and did not report the incident. Dialysis staff members sent the resident to the emergency room, and she was diagnosed with a hematoma to the back of the head.

In the decades I have practiced law in this area, I have handled several similar cases where serious injury or death occurs when a resident is not transported according to the safety protocol for a wheelchair harness. The wheelchair needs to be transported with a specialized van that has strapped designed to hold the corners of the wheelchair and there are additional safety belts for the passenger in the wheelchair. Preventable injuries occur when the wheelchair is not strapped in properly. When the vehicle stops or turns the passenger can fall from the chair striking the interior of the fall and floor.
