St Raphaels Health Eveleth Complaint Findings for Physical Abuse
In a report concluded on July 15, 2013, the Minnesota Department of Health cites St Raphaels Health Eveleth for physical abuse by staff.
It is alleged that abuse occurred when a resident was slapped in the face and then on the leg by the nursing assistant, alleged perpetrator (AP).
Substantiated Complaint of Abuse Against St Raphaels Health in Eveleth
Based on a preponderance of the evidence abuse is substantiated. The AP slapped the resident twice when the resident grabbed her/him inappropriately. The AP stated she/he “pushed the resident on the leg resulting in a slapping sound” when the resident grabbed her/his genitals. There was another nursing assistant in the room at the time and verified hearing a slapping sound however, did not see the AP slap the resident.
The internal investigation was reviewed and the administrative personnel interviewed. During the investigation the AP initially stated she/he did not slap the AP but “nudged” the resident on the leg however’ came forward to the administration a short time later and stated she/he was not completely forthcoming and had slapped the resident on the leg once when the resident didn’t let go the AP slapped her/him on the leg a second time.
