The nursing home facility has a duty to explain the care and treatment as well as the initial comprehensive assessment and care plan. It is required that a comprehensive person-centered care plan is in place for each resident based on their doctor’s orders and needs.

Elder abuse and neglect occur when a facility fails to meet minimum standards. It can happen when a facility is short staffed or does not have enough well-trained employees to provide all the care is necessary for each resident. The neglect can because directly from the staff in situations where there is a fall from a patient left or an issue during a staff transfer from wheelchair to toilet or other transfer. Sometimes the injuries are due to omissions such as a failure to provide proper wound care and assessment. Many times, there is a complicating factor of a delay in response after there is a change in condition which reduces the options for treatment.
