Minnesota Nursing Home Abuse Attorney

Nursing Home Abuse Attorney Kenneth LaBore has made his career representing vulnerable populations for serious injuries and wrongful death throughout the state of Minnesota. There are many types of preventable abuse and neglect which can result in serious injuries and death to residents in care facilities.

Residents are required by law to require appropriate care based on their needs to the highest level practicable. The risks for each resident must be assessed and a care plan developed for each directing staff on how to provide care and services. Neglect is when the needs are not assessed, or there is not an appropriate intervention taken to reduce or mitigate risks and care plan is not complete is not followed.

Nursing Home Neglect Cases - This is What we Do

As an attorney who has practiced in nursing home neglect and assisted living abuse for over three decades. I have handled hundreds of cases against many of the state’s care facilities. Residents in hospitals, nursing homes, assisted living facilities, and others are considered vulnerable adults by definition and are protected by the law. As we age or have infirmities our ability to advocate and care for ourselves diminishes. The type of situations which lead to serious injury or death in care facilities are often easily avoided with proper care. Many of the injuries I see have been the result of improper use of equipment such as patient mechanical lifts, aka Hoyer lifts. Injuries also occur from medication errors, a failure to notice a change in a resident’s condition, or some other omission or mistake. It is essential that care facilities have properly trained staff and adequate numbers of nurses and aides to provide for the necessary care for all the residents in a facility.

Answer: There has historically not always been a claim for “pain and suffering” for the victim of neglect where the injuries result in their death. It was not until 2023 when Minn. Stat. § 573.02 was amended to add the claim “the recovery in the action is the amount the jury deems fair and just for all damages suffered by the decedent resulting from the injury prior to the decedent's death”, which includes pain and suffering.

Answer: The Minnesota Department of Health maintains a site to search for Health Care Provider Complaints. The site includes information about the complaints if they were substantiated as well as what measures were taken to improve the facility afterwards.

Answer: There is a Minnesota Adult Abuse Reporting Hotline Center (MAARC), which intakes elder abuse and neglect concerns and is answered 24 hours a day at 1-844-880-1574.
